Former Senior Living Center Employee Charged with ID Theft and $335,000 Fraud
 
        BIRMINGHAM — The U.S. Attorney’s Office today charged a former Hoover senior living center employee with using the identity of a resident with dementia, without authorization, to steal more than $300,000 from the resident’s bank and credit accounts, announced U.S. Attorney Joyce White Vance and U.S. Secret Service Special Agent in Charge Craig Caldwell.
 
        Federal prosecutors charged SHOSTOCKA KEYA WARD, 43, of Vestavia Hills, with bank fraud and aggravated identity theft in an information filed in U.S. District Court. Prosecutors also filed a plea agreement with Ward, in which she acknowledges the charges and agrees that she will plead guilty to one count of bank fraud and one count of aggravated identity theft. She also agrees to pay restitution of $335,214 and to forfeit that same amount to the government as proceeds of illegal activity.
 
        According to Ward’s plea agreement, her fraud included writing more than $70,000 in unauthorized checks to herself and using one of the victim’s credit cards for expenses including financing her own wedding, applying money to someone’s prison account, making car and private school tuition payments, and taking trips to Las Vegas, Chicago, Tunica, Miss., and Gatlinburg, Tenn.
       
        According to the government’s charging document and Ward’s plea agreement, she worked at Galleria Woods as a resident assistant or a transportation coordinator from about August 2010 to January 2014. In 2011, Ward became acquainted with the victim, a Galleria Woods resident who was 75 years old, had no immediate family, few visitors and an out-of-town family friend who served as her power of attorney, but was not actively involved in her daily care or the management of her daily finances.
 
        Ward began assisting the victim with transportation, errands, bill payments and other financial issues, and gained access to the victim’s purse, mail, financial statements, checkbook, and debit and credit cards, according to the information. Ward maintained her relationship with the victim during her employment at Galleria Woods as the victim’s mental and physical condition declined and she became incapable of managing her financial affairs, according to the charges against Ward.
 
        Between Oct. 11, 2011, and Feb. 13, 2014, Ward carried out a scheme to defraud eCO Credit Union of money in the victim’s account through various means and without the victim’s authorization, according to the information and plea agreement. Ward used the victim’s checks for her own benefit, often forging her signature, and obtained a check/ATM card on the eCO account, according to the charges. Ward used the checks and the debit card to obtain cash and to pay for goods and services worth more than $120,000, according to the information. She also used the victim’s Chase Bank, State Farm Bank and Macy’s Department Store credit cards for hundreds of thousands of dollars in personal expenses and purchases, and paid portions of those bills with money from the victim’s credit union account to continue the scheme.
 
        The maximum prison penalty for bank fraud is 30 years. The penalty for aggravated identity theft is a mandatory two years in prison, which must be served after completion of any other prison sentence imposed for the crime.
 
        U.S. Secret Service investigated the case, which Assistant U.S. Attorney Erica Williamson Barnes is prosecuting.

President Obama Visits Birmingham Laying Out His Plans for an Issue that Birmingham City Councilors Have Long Had Concerns For
As Congress readies for the next fiscal year, United States President Barack Obama took note and packed a bag to Birmingham to discuss what citizens could expect from Congress in the upcoming budget. Using a platform centered on “middle class economics” the President outlined what he hopes to accomplish with new laws and initiatives to help working families. Specifically he dissected the dangerous cycle of payday lending and how ‘new proposed federal regulations for the industry’ should be put in place to combat this issue that keeps so many families in bondage.
“There are four times as many payday loans as there are McDonalds in the state of Alabama,” said President Obama. “We must put laws in place to make sure our folks aren’t getting taken advantage of.” He further emphasized our need to teach young people ‘as we indeed are our brother’s keeper’ the need to be financially educated at a young age, citing decisions that they make can have long term consequences for the family. He used an example of one family who borrowed payday loans to get out of loans and instead ended up worse than they began. President Obama said if this is the business of payday lending institutions, then they ‘need to find a new way of doing business.’
Most of the Birmingham City Councilors attended and took note as they felt the need to recharge their standpoint on this near decade-old debate that began with Councilor Hoyt in 2008. Councilor Hoyt then made the issue known of the sudden growth and negative impact of payday lender businesses in the City of Birmingham and received an opinion from the City of Birmingham law department that councilors could not regulate their business, but that there might be other options afforded to councilors. He and other contributing colleagues on the council are pleased that the dire issue is now getting its due assessment.
Not to let the issue dissolve, Councilor Kim Rafferty then picked up the loose ends and discovered the zoning option, which Councilor Valerie Abbott closely mentored through the system, resulting in the ordinance modifications approved by the council in which Councilor Lashunda Scales moved for its moratorium.
“It was a challenge as we kept the moratorium in place while Councilor Abbott and others worked with zoning and the law department to strengthen the City code that
limits the number of lenders in the city,” Councilor Rafferty said. “The council passed those amendments in 2012 and 2013 and the moratorium was lifted. The biggest hindrance is that the state Legislature voted to recognize them as legit banking operations in our state laws and local jurisdictions have only the power to limit them under zoning laws.”
The Birmingham City Council’s collective teamwork brought about numerous banking options and products led by Councilor Rafferty such as Bank on Birmingham, an initiative to get banking institutions to become invoked in reaching under banked citizens with viable options other than payday lending. Bank on Birmingham is also a
partnership between the banking industry in the City of Birmingham and the nonprofit
organizations who counsel the victims of payday lending practices.
“We are glad to see that this issue is now getting the attention of the federal government through President Obama so that strict regulations can be put in place, Councilor Rafferty said. “It’s important that citizens, no matter what economic status they hold, are able to move forward and continue to provide for their families.”

Litter patrols and neighborhood clean-up efforts are in high demand throughout Birmingham as the war against illegal dumping continues. City council members say they often are forced to take a hard stance surrounding this self-inflicted problem. Councilor Marcus Lundy says residents need to start picking up their trash as well as reporting others who illegally litter. Trash dumps along neighborhood streets are creating a serious safety hazard so city leaders are asking residents to take new pride in their surroundings and report offenders.

First Lady Teams Up with PBS and WGBH Boston to Launch Fourth Annual Nationwide Healthy Recipe Challenge

WASHINGTON, D.C. – First Lady Michelle Obama is teaming up with PBS flagship station WGBH Boston, the U.S. Department of Education, and the U.S. Department of Agriculture to host the fourth annual Healthy Lunchtime Challenge & Kids’ “State Dinner” to promote cooking and healthy eating among youth. Teaching kids to cook is a great way to ensure they learn healthy habits early in life. Research shows that children who help with cooking and meal preparation are more likely to consume fruits and vegetables, and they are more aware of the importance of making healthier food choices. The Healthy Lunchtime Challenge & Kids’ “State Dinner” invites kids, ages 8-12, with the help of their parents or legal guardians to create and submit a recipe at pbs.org/lunchtimechallenge for a lunch that is nutritious and delicious.
This year, WGBH Boston is joining the First Lady to present the Healthy Lunchtime Challenge & Kids’ “State Dinner” in an effort to raise national awareness about the importance of healthy cooking and eating. To make the challenge possible for kids and their families across America, support is being provided to WGBH by Newman’s Own® and Newman’s Own Foundation.
The Healthy Lunchtime Challenge & Kids’ “State Dinner” invites kids, in collaboration with a parent or guardian, to create an original lunch recipe that is healthy, affordable, and tasty. In support of Let’s Move!, launched in 2010 by the First Lady to help kids and families lead healthier lives, entrants are encouraged to reference ChooseMyPlate.gov  to ensure recipes meet the USDA’s recommended nutrition guidelines. Entries should represent each of the food groups, either in one dish or as parts of a lunch meal, including fruits, vegetables, whole grains, lean protein and low-fat dairy. Kids from all U.S. states and territories are invited to participate, including Washington, D.C., Puerto Rico, Guam, American Samoa, the U.S. Virgin Islands, and the Northern Mariana Islands. One winner from each and a parent or guardian will win the opportunity to be flown to Washington D.C. and the opportunity to attend the Kids’ “State Dinner” at the White House, hosted by the First Lady, where a selection of the winning healthy recipes will be served.

IRS Has Refunds Totaling $1 Billion for People Who Have Not Filed a 2011 Federal Income Tax Return

WASHINGTON — Federal income tax refunds totaling $1 billion may be waiting for an estimated one million taxpayers who did not file a federal income tax return for 2011, the Internal Revenue Service has announced. To collect the money, these taxpayers must file a 2011 tax return with the IRS no later than Wednesday, April 15, 2015.
“Time is running out for people who didn’t file a 2011 federal income tax return to claim their refund,” said IRS Commissioner John Koskinen. “People could be missing out on a substantial refund, especially students or part-time workers. Some people may not have filed because they didn’t make much money, but they may still be entitled to a refund.”
The IRS estimates half of the potential refunds for 2011 are more than $698.
In cases where a tax return was not filed, the law provides most taxpayers with a three-year window of opportunity for claiming a refund. For 2011 tax returns, the window closes on April 15, 2015. If no return is filed to claim a refund within three years, the money becomes property of the U.S. Treasury.
The law requires the tax return be properly addressed, mailed and postmarked by that date. There is no penalty for filing a late return that qualifies for a refund.
The IRS reminds taxpayers seeking a 2011 refund that their checks may be held if they have not filed tax returns for 2012 and 2013. In addition, the refund will be applied to any amounts still owed to the IRS, or their state tax agency, and may be used to offset unpaid child support or past due federal debts, such as student loans.
By failing to file a tax return, people stand to lose more than just their refund of taxes withheld or paid during 2011. Many low-and-moderate income workers may not have claimed the Earned Income Tax Credit (EITC). For 2011, the credit is worth as much as $5,751. The EITC helps individuals and families whose incomes are below certain thresholds. The thresholds for 2011 were:

·       $43,998 ($49,078 if married filing jointly) for those with three or more qualifying children,
·      $40,964 ($46,044 if married filing jointly) for people
with two qualifying children,
·       $36,052 ($41,132 if married filing jointly) for those with
one qualifying child, and
·       $13,660 ($18,740 if married filing jointly) for people
without qualifying children.

Current and prior year tax forms and instructions are available on the IRS.gov Forms and Publications page, or by calling toll-free: 800-TAX-FORM (800-829-3676). Taxpayers who are missing Forms W-2, 1098, 1099 or 5498 for the years: 2011, 2012 or 2013 should request copies from their employer, bank or other payer.
If these efforts are unsuccessful, taxpayers can get a free transcript showing information from these year-end documents by going to IRS.gov. Taxpayers can also file Form 4506-T to request a transcript of their tax return.

  NATIONWIDE (BlackNews.com.) — Can there be anything more insidiously proposed; is there anything more ironically insane then this narrative? Let us look at this for what it is. Millions in America, and I do mean millions, thought their vote for Barack Obama would once-and-for-all deal a death blow to our past slavery and segregation stigma and signify to the world that racism is dead in America.
Rasmussen reported recently, “Despite high hopes to the contrary, voters continue to believe the racial picture in this country has gotten worse since the election of the first Black president. A national telephone survey finds that only 8 percent of likely U.S. Voters think race relations are better since President Obama’s election six years ago. Forty-two percent believe race relations are worse now, while slightly more (48%) say they have stayed about the same.” But it doesn’t end there, for now under the administration of the first Black president you have the suggestion of putting the notorious eugenic, Margaret Sanger, on the 20 dollar bill! So much for… “Black Life Matters!”
Margaret Sanger, who was perhaps the most diabolical racist of our times said in, Pivot of Civilization, referring to African-Americans, immigrants, and poor people, that they were “…human weeds,” “…reckless breeders…,” “…spawning… human beings who never should have been born….” Moreover in her letter to Clarence Gamble, of Proctor and Gamble soap company, himself a staunch advocate of birth control and eugenics, Margaret Sanger further most succinctly stated,
“We should hire three or four colored ministers, preferably with social-service backgrounds, and with engaging personalities. The most successful educational approach to the Negro is through a religious appeal. We don’t want the word to go out that we want to exterminate the Negro population and the minister is the man who can straighten out that idea if it ever occurs to any of their more rebellious members….”
I would certainly be considered a “more rebellious member” and I vehemently protest and find it outrageous in these times of “Political Correctness” that she should even be considered for the 20 dollar bill. Remember Jimmy the Greek’s comments about African-American athleticism and future coaching positions? Career over, even after receiving support from player union representatives, Gene Upshaw and Ahmad Rashad…. Or more recently with Donald Sterling’s comments to his mistress –in private –about bringing Black players to his games (who was more jealous about their athleticism with her than their color) resulting in being banned from basketball. Bruce Levenson, who was blaming African-American fans for the lack of corporations and white people from buying season suite purchasers. Or Rodner Figueroa, who is openly gay, and whose father is half African-American, who was fired after a call from the White House –(oh the hypocrisy, it’s killing me) –for comparing Michelle Obama to a character in the movie, “The Planet of the Apes.” All of the above mentioned, profusely offered up apologies, but received no pardon and now you are going to put on the 20 dollar bill the image of an individual who called African-Americans, human weeds, reckless breeders and accused them of spawning persons that should have never been born… On the 20 dollar bill!
Now to all the African-American readers of this article, watch for the response from the NAACP… The Congressional Black Caucus… The National Action Committee (Al Sharpton)… The Rainbow Coalition (Jessie Jackson)… Or, Barack and Michelle Obama… ‘…three or four colored ministers…’all. You will not see them say one word of protest nor contrary response to the name of Margaret Sanger due to the fact that they all are in bed with the leading killer of African-Americans: Planned Parenthood. They find it acceptable for America’s leading abortion provider not only to get your tax dollars, but are free to cast racially derogatory slurs against you and your ancestry. Ask any of these organizations how they feel about Margaret Sanger being on the Twenty Dollar Bill, and for the record, request it in writing.
And please don’t forget Barack and Michelle in your request for a response.

Don’t be Fooled, Phone Scams Continue to be Serious Threat Nationwide

WASHINGTON — As April 1st approaches, the IRS warns taxpayers not to be fooled by the tricks scammers use to take advantage of those they target. Scammers use fake names, provide bogus IRS badge numbers and alter caller ID numbers to make it look like the IRS is calling.
With the final two weeks of the filing season about to begin and millions preparing their returns, taxpayers should be alert.
“This is no April Fool’s joke. Everyone should be on the lookout for threatening calls from people faking IRS phone numbers and demands for immediate payment,” IRS Commissioner John Koskinen said. “These are scams. I urge taxpayers to stay vigilant and remain aware of the constantly changing tactics used by these criminals.”
As the filing season nears its end, there has been a surge of phone scams where scam artists threaten police arrest, deportation, license revocation and other threats.
They often leave “urgent” callback requests and sometimes prey on the most vulnerable people, such as the elderly, newly arrived immigrants and those whose first language is not English. Scammers have been known to impersonate agents from IRS Criminal Investigation as well.
Here are five things the scammers often do but the IRS will not do.
The IRS will not:
·         Call to demand immediate payment, nor will the agency call about taxes owed without first having mailed you a bill.
·         Demand that you pay taxes without giving you the opportunity to question or appeal the amount they say you owe.
·         Require you to use a specific payment method for your taxes, such as a prepaid debit card.
·         Ask for credit or debit card numbers over the phone.
·         Threaten to bring in local police or other law-enforcement groups to have you arrested for not paying.
If you get a phone call from someone claiming to be from the IRS and asking for money, here’s what you should do:
·         If you know you owe taxes or think you might owe, call the IRS at 1-800-829-1040. The IRS workers can help you with a payment issue.
·         If you know you don’t owe taxes or have no reason to believe that you do, report the incident to the Treasury Inspector General for Tax Administration (TIGTA) at 1-800-366-4484 or report it online at the IRS Impersonation Scam Reporting Page.
·         If you’ve been targeted by this scam, also contact the Federal Trade Commission and use their FTC Complaint Assistant at FTC.gov. If the complaint involves someone impersonating the IRS, include the words “IRS Telephone Scam” in the notes.
Remember, too, the IRS does not use email, text messages or any social media to discuss your personal tax issue involving bills or refunds. For more information on reporting tax scams, go to IRS.gov and type “scam” in the search box.

The Jefferson County Commission will receive bids for the Fairfield Sidewalk Project at Room 270 of the Jefferson County Courthouse until 9:00 a.m. local time on the 14th day of April, 2015, at which time and place all bids will be publicly opened and read aloud.
