WASHINGTON (AP) — The Army Green Berets who requested the Oct. 3 airstrike on the Doctors without Borders trauma center in Afghanistan were aware it was a functioning hospital but believed it was under Taliban control, The Associated Press has learned.

The new information adds to a body of evidence that the internationally run medical facility site was familiar to the U.S. military, raising questions about whether the decision to attack it violated international law.

A day before an American AC-130 gunship attacked the hospital, a senior officer in the Green Beret unit wrote in a report that U.S. forces had discussed the hospital with the country director of the medical charity group, presumably in Kabul, according to two people who have seen the document.

The attack left a mounting death toll, now up to 30 people.

Separately, in the days before the attack, “an official in Washington” asked Doctors without Borders “whether our hospital had a large group of Taliban fighters in it,” spokesman Tim Shenk said in an email. “We replied that this was not the case. We also stated that we were very clear with both sides to the conflict about the need to respect medical structures.”

Taken together, the revelations add to the growing possibility that U.S. forces destroyed what they knew was a functioning hospital, which would be a violation of the international rules of war. The Pentagon has said Americans would never have intentionally fired on a medical facility, and it’s unclear why the Green Beret unit requested the strike – and how such an attack was approved by the chain of command – on coordinates widely known to have included a hospital.

Even if the U.S. believed the Taliban were operating from the hospital, the presence of wounded patients inside would have made an air attack on it problematic under standard American rules of engagement and the international law of war.

Pentagon spokesman Maj. Roger Cabiness declined to answer questions, saying in a statement that it would be “premature to draw any conclusions” before the three investigations into the attack are complete.

The U.S. has determined “that the reports of civilian casualties were credible, and we continue to work with the government of Afghanistan to fully identify the victims,” said Brig. Gen. Wilson Shoffner, a NATO spokesman, in a statement. U.S. and NATO investigations, he said, “continue to look at a series of potential human errors, failures of process and technical malfunctions that may have contributed to the mistaken strike on the hospital.”

“MSF report that they have personnel in the trauma center,” the Oct. 2 report by a senior Green Beret officer from 3rd Special Forces Group said, according to two people who have seen it. MSF is the abbreviation for the group’s French name, Medicins sans Frontiers. The report adds that the trauma center was under the control of insurgents, said the sources, who would not be quoted by name because they were not authorized to discuss it publicly.

The coordinates of the hospital were sent to “all friendly forces,” the report said, noting that among the U.S. objectives for the next day was to “clear the trauma center” of enemy forces.

Doctors without Borders officials say the hospital was not under Taliban control and that no gunmen were operating from within the compound – about six city blocks square with the one-story hospital situated some two blocks back behind a 12-foot wall – when the AC-130 gunship made five passes, firing for an hour.

Another hospital run by Afghanistan’s health ministry, a short distance away, had been overrun by the Taliban when insurgents seized the city, a senior U.S. defense official said.

The new information raises the possibility that some elements of the U.S. intelligence and military apparatus had confused the two hospitals. But other evidence argues against such confusion.

The AP has reported that American special operations analysts were gathering intelligence on the Doctors without Borders hospital, including indications it was being used by a Pakistani operative to coordinate Taliban activity. The intelligence gathering occurred as the U.S. was supporting the Afghan effort to retake Kunduz, which included heavy fighting by Green Berets.

The Green Berets had asked for Air Force intelligence-gathering flights over the hospital, and both Green Berets and Air Force personnel were aware it was a protected medical facility, the records show, according to the two people who have seen the documents.

The analysts’ dossier included maps with the hospital circled, along with indications that intelligence agencies were tracking the location of the Pakistani operative and activity reports based on overhead surveillance, according to a former intelligence official who is familiar with some of the documents. The intelligence suggested the hospital was being used as a Taliban command and control center and may have housed heavy weapons.

After the attack, some U.S. analysts assessed it was justified, the records show, and one report said 16 enemies had been killed, the two sources say. Those deaths were said to include the Pakistani, who the U.S. believed was working for his country’s Inter-Service Intelligence directorate.

No evidence has surfaced publicly suggesting a Pakistani died in the attack, and Doctors without Borders says none of its staff was Pakistani.

Gen. John Campbell, commander of American forces in Afghanistan, has said that “a special operations unit that was in close vicinity … was talking to the aircraft that delivered those fires.”

A senior Green Beret officer has told superiors that his troops, accompanying Afghan security forces, were under fire and in danger, according to a former government official familiar with his account.

Doctors without Borders denies that any fire was coming from its compound. And even if it was, it’s unclear why any U.S. forces outside those walls could not have moved to safer ground.

Also a mystery is why the AC-130 gunship would have kept firing during the course of an hour on a building that both the Air Force and the Army knew was an internationally run trauma center. To avoid civilian casualties, a gunship would typically stop firing as soon as it achieved its objective – in this case, ostensibly, protecting U.S. forces. Generally, the aircraft would require further clearance from the troops on the ground to continue firing.

An AC-130 gunship flies low and slow, often with a good view of its target and the damage it is inflicting. The pilot also would have had to know the locations of U.S. and allied forces in the area, to avoid hitting them.

Doctors without Borders has said it was frantically calling Kabul and Washington during the attack, trying to make the U.S. aware of what was unfolding as patients died in their beds.

Presumably, the gun camera video from the plane would show whether anyone was firing from the hospital. The U.S. government has yet to make it public.

‘Empire’ Ends Three-Week Ratings Slide

Breaking a three-week ratings decline and seeing its first uptick of its second season, “Empire” was back last night with a 2% rise among adults 18-49 from the final numbers of its October 14 show.

Impressive enough against the MLB Playoffs, which have chewed into Empire’s numbers the past few weeks, the series is up 4% fast nationals-to-fast nationals and could see an adjustment later today, reports Deadline.com. Among viewers, “Empire” is even with last week’s 12.2 million.

The hip hop drama was certainly helped by the 8–3 score in the Mets vs. Cubs game and also by its lead-in “Rosewood,” seeing a 7% bump up in the key demo from last week. All of which puts Fox at the top spot both in the 18-49s with a 3.1/10 rating and total audience of 8.70 million.

TOM FORD IS DESIGNING A LIPSTICK INSPIRED BY…DRAKE?

He might well just accept the fact that he’s going to get blasted by comedians until they get tired or find something different.

We’re talking about Drake being in the lipstick business. Well, kinda, sorta.

According to HipHollywood, designer Tom Ford is putting a lipstick on the market named after the Canadian rapper. The dark burgundy lipstick, which drops next week, will retail for $52.

It seems Drake won’t be the only who’s caught the attention of Tom Ford. Actor Jake Gyllenhaal will also have a lipstick released under Ford’s “Lips & Boys” collection.

Actually Drake and Ford have a bit of history. Remember when the C anadian rapper released a song titled, “Tuscan Leather” in 2013? Well, it was named after one of Ford’s fragrances.

Dirt Dash 5K Fun Run/Walk – Birmingham Botanical Gardens holds its Fourth Annual Dirt Dash 5K Fun Run/Walk Saturday, November 14 at The Gardens.  Serious runners and casual walkers will be able to enjoy paths through Alabama’s largest living museum. Rosenwald, Film About Jewish Philanthropist who Worked With Booker T. Washington to Premiere in Birmingham

If you’re looking for something to do this weekend, Director Aviva Kempner’s got you covered.

Rosenwald, a film about Julius Rosenwald, will premiere at The Edge Theater tonight .

Rosenwald journeys through the life of Sears and Roebuck President Julius Rosenwald, and his philanthropy to the black community.

Partnering and being influenced by Booker T. Washington, Rosenwald provided thousands of schools to the African American communities throughout the country, including in Alabama.

In Tuskegee, Washington and Rosenwald had schools built from the ground up for children in the community.

“I think it’s a very rich history of Alabama,” Kempner said. “His involvement was because of Booker T. Washington. It tells a very important story of African American history as well as American history.”

The film, which took 12 years to make, features many prominent people in the Black community, including Maya Angelou, Julian Bond, and Rita Dove.

Many of the Rosenwald Schools, as they have been called, are now up for preservation. Rosenwald donated over $62 million in his lifetime.

“He was an under-known Jewish hero,” Kempner said. “He is also one of the biggest heroes. He didn’t want fame, he just wanted to make a difference.”

Kempner spoke on how doing this film was educational for her as well.

“One thing I learned is that the black press is a powerful thing,” Kempner said. “The power and the courage of it was a strong thing.”

She also discovered the determination that the Black community has.

“Education was a hard thing for African Americans to obtain at that time,” Kempner sai. “It was the courage of the African American community that strived together. It was what everyone had in common; they wanted education.”

After the film, which takes place at Tuskegee University, Valdosta State, areas in Chicago and Nashville, Kempner admitted that she cried.

“I was happy it was done.”

‘Don’t bury me’: Dying boy’s words bring Yemen’s forgotten war back into focus

(CNN)“Don’t bury me.” 9-year-old Fareed Shawky cries as doctors treat his many shrapnel wounds.

He is just a child. But more than six months of war in his country, Yemen, had taught him the bitter realities of conflict. People die, then they are buried.

“Don’t bury me,” Fareed says again through tears.

One of the medical staff laughs as he pats the child’s small legs to comfort him.

The interaction was filmed this month by Ahmed Basha, a local photographer who recounted the story to CNN.

“I thought he was just injured,” Basha says from his home in Taiz, Yemen’s third-largest city. “I wasn’t even sure I had been recording when he said this. I was more concerned with my still photography.”

Days later, Fareed died of wounds to his head. The boy was buried, hurriedly, in a family graveyard.

When Basha got word of the child’s death, he began sifting through his footage. He published the video of the boy begging to live and began telling the world his story.

It was quickly picked up by social media at a time when little else on Yemen’s war seems to gain much attention.

It is the war the world forgot, activists say, and little Fareed is reminding us.

A ‘human catastrophe’

Two rival factions are vying for power in Yemen: the Shiite Houthi rebel movement and the backers of ousted President Abdu Rabu Mansour Hadi.

But the conflict is not binary. A secessionist movement in the south, a strong al Qaeda presence along the coast and the recent rise of ISIS all contribute to an increasingly volatile situation.

The battle for control triggered the formation of an Arab coalition, led by Saudi Arabia, to intervene on behalf of the Hadi’s internationally recognized government.

The Saudis and their predominantly Sunni allies consider the Houthis, who hail from northern Yemen, to be proxies for the Shiite government of Iran and fear another Shiite-dominated state in the region. The Houthis deny Iran supplies any direct material support.

Airstrikes, battles and other spurts of bloodshed have taken their toll. The United Nations has attempted repeatedly, but to no avail, to resolve what it calls a “human catastrophe” that had killed or wounded more than 27,000 people as of midsummer, according to the U.N. Office for the Coordination of Humanitarian Affairs (OCHA), and has left 80% of the population in need of humanitarian assistance.

Four out of every five Yemenis are lacking the most basic things, including water, food, adequate medical care, and shelter, according to OCHA.

Fareed’s story spreads

For all this suffering, that doesn’t mean Yemenis have given up.

Fareed’s story is now emblematic of Yemen’s struggles — and resilience. Activists are using the hashtag #dontburyme to call for an end to the bloodshed. The boy is being called the “Aylan Kurdi of Yemen” a reference to the Syrian toddler whose body washed up on a Turkish shore in September.

“Fareed saw burial of neighbor kid killed by Houthi shell & was traumatized. Hence pleaded #DontBuryMe .. #Yemen” Hishal al-Omeisy, a prominent Yemeni activist, posted on Twitter.

The hashtag originally started in Arabic, but as the story spread, more users began using the English version.

“A child in #taiz told his father after he was injured: do not bury me. Sadly, the father could not [fulfill] his son’s call.#Dontburyme” Kawkab Ahmed, a Turkish observer, said on the microblogging site.

No safe place

 When Saudi Arabia announced it would lead a coalition to forcibly remove the Houthis from its neighbor to the south, it launched an aerial campaign sure to devastate one of the poorest and least developed countries in the Middle East.

The Houthi movement formed in 1994 with the explicit political aim of gaining greater autonomy and defending its follower’s religious traditions as members of the Zaidi branch of Shiite Islam. The group has been at war with the central government for more than a decade, but their entry into Sanaa in September brought things to a head.

Hadi and Prime Minister Khaled Bahah resigned in January under Houthi pressure, a few months after the rebels had fought their way into the capital, Sanaa, and demanded greater political influence. The kingdom says an exiled Hadi pleaded for military intervention in a letter posted by the country’s foreign ministry in March.

More than six months into the Gulf-led offensive, Saudi Arabia has yet to reach its stated political objective. Instead, the war has shattered the already beleaguered population.

U.N. report: Most dangerously violent place for civilians

Children and education are among the first victims of a conflict where each of the warring parties has demonstrated a flagrant disregard for civilian life, according to an Amnesty International report published this summer.

There is no safe place. Not even for children.

Of the Yemenis who have been killed or injured by explosive weapons in towns or cities, 95% were civilians, according to a recent U.N. report. Five hundred of the dead were children, according to UNICEF.

“Our findings show Yemen is the worst country in the world this year for civilians affected by explosive violence, more devastating even than the crisis in Syria and Iraq,” Robert Perkins, author of the report said this month.

“An already vulnerable population is now faced with a country reduced to rubble by falling bombs and rockets. Their homes destroyed, their families torn apart, it will take a many years to recover from the last few terrible months in Yemen.”

Fareed’s family blame the Houthi rebels for his death. The boy was playing just outside his home when he was struck in a missile attack. Four other children also were wounded.

“The family were thankful Fareed’s story reached the world,” Basha tells CNN, “They hope this will change the lives of Yemenis who have been suffering for so long.”

Early Notice and Public Review of a Proposed 

Activity in a Floodplain 

To:  All interested Agencies, Groups and Individuals

This is to give notice that Jefferson County, Alabama under 24 CFR Part 58 has determined that the following proposed action under the Community Development Block Grant program and HUD grant number B-14-UC-01-0001 is located in the 100-year floodplain and Jefferson County, Alabama will be identifying and evaluating practicable alternatives to locating the action in the floodplain and the potential impacts on the floodplain from the proposed action, as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.

  1. 1. The following is a description of all of the proposed activities that are located with the floodplain:
  1. a. Existing activities that are occurring before proposed project is constructed: Use of the community center, ball fields and outdoor water splash park.
  2. b. Proposed construction activities: Proposed activities include removing and replacing existing chain link fencing around existing recreational fields, minor grading to reduce ponding water on one of four existing fields, and construction of an asphalt parking lot. Parking lot construction will take place in a previously disturbed area where a dilapidated structure and an existing gravel storage area are currently located.
  3. c. New activities when proposed project is completed: No new activities will occur.  This project enhances the existing ball fields, and the proposed parking will be for use by people using the existing facilities. 
  1. 1. The total number of acres of the floodplain: There are approximately 15.2 acres within the floodplain boundary, on the project property.
  2. 2. The total number of acres of the activity within the floodplain: The total land disturbance within the floodplain encompasses approximately 0.7 acres; 0.37 acres making up the proposed asphalt parking area and .33 acres resulting from the removal and re-installation of fence post structures and miscellaneous improvements.
  3. 3. The related natural and beneficial values potentially adversely affected by the activity:  The related natural and beneficial functions of the existing floodplain within the project property are limited, as this area is currently developed with structures, parking area and recreational fields. The proposed project will have no significant impact on the remaining beneficial water resource functions of the floodplain including conveyance and storage of excess stream flow and groundwater recharge. Proposed fence replacement will not hinder storage capacity of floodwaters. While the parking lot will necessarily include reduction of the impervious area within the larger site, the small size relative to the much greater floodplain combined with the current non-natural condition of the area will result in no significant impacts or adverse effects to the related natural and beneficial functions and values of the floodplain.
  4. 4. The proposed Midfield Park Improvements project is located at 410 Grant Street in Midfield, Jefferson County, Alabama.

There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.  Commenters are encouraged to offer alternative sites outside of the floodplain can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

Bid documents may be viewed and purchased through the City of Birmingham online plans room site at http://BirminghamBids.algraphics.com.  Any cost for reproduction shall be the responsibility of bidders.

Since award may not be made within thirty (30) days, no bid may be withdrawn for a period of sixty (60) days after the date of the bid opening.

The City reserves the right to reject any or all bids submitted, and to waive any informalities.

IMPORTANT BIDDER INFORMATION

Bidders are expected to prepare their bid to include all necessary material, labor, bonds, permits, overhead, profit, taxes, insurance, etc. costs.  It is not the City’s obligation to bring mistakes/omissions in bid to bidder’s attention.  If after bid opening, a bidder determines he has a mistake in bid, he may seek withdrawal of his bid without forfeiting his bond, if the request is in writing within three (3) work days after the bid opening, and is accompanied by clear and convincing evidence of the mistake.

All cashier’s checks or bid bonds will be returned immediately after bids are checked and tabulated to all except the three (3) lowest bona fide bidders.  Bid bonds shall be returned to the three (3) lowest bona fide bidders when the contract is signed and performance and payment bonds and insurance are furnished by the successful bidder.  If award is not made within fifteen (15) days after bid opening, all bid guarantees will be returned except for those of the potentially successful bidders.  If after sixty (60) days, no award has been made, all bids shall be rejected and the potentially successful bidder’s guarantee will be returned unless the bidder agrees in writing to a time extension.  If a time extension is effected, bidder may substitute any cashier’s check for a satisfactory bid bond.

Any contract resulting from this Invitation to Bid shall not be assignable without prior written consent of the City.  Under no conditions, shall the contract be assigned to an unsuccessful bidder whose bid was rejected as non-responsive and/or non-responsible.

A Notice to Proceed will be issued by the City within fifteen (15) days after final contract execution unless both parties agree in writing to a longer period of time.

Special attention is called to the applicability of the Birmingham Plan-Construction Industry Program to the project.  Under this Program, the utilization of Minority Business Enterprises and Disadvantaged Business Enterprises (MBE/DBE) is encouraged on a voluntary basis.  The Construction Industry Authority established a system of floating MBD/DBE goals which may differ from year to year and project to project.  Overall, these goals shall not be less than the historical participation of MBD/DBE’s in construction projects of the City and its agencies.  Additional information about this Program is contained in the Project Manual and may be obtained from the Executive Director, Birmingham Construction Industry Authority at 3600 4th Avenue, South, Birmingham, Alabama  35222 (Telephone:  205-324-6202).  For federally funded contracts, the provisions of the President’s Executive Order 11246 and federal agency regulations requiring affirmative action to achieve employment and utilization of minority persons and business will apply.

As a matter of public policy, the City of Birmingham agrees to make opportunities available to the maximum extent possible, to actively include Historically Underutilized Business Enterprises (HUBE’s) such as architectural firms, engineering firms, investment banking firms, other professional consultant services providers, and construction contractors as part of business, economic and community revitalization programs.

Bids must be submitted in a sealed envelope marked: SEALED BID – A NEW BUILDING FOR BIRMINGHAM PUBLIC LIBRARY—WYLAM BRANCH. Bids may be hand delivered to Conference Room 215 City Hall, Birmingham, Alabama, or mailed to:  City of Birmingham Planning, Engineering and Permits Department, Architectural Division, Room 220 City Hall, 710 North 20th Street, Birmingham, Alabama 35203.  Bids sent by any express carrier (Federal Express, UPS, Airborne, etc.) must specify delivery to Room 220 City Hall.

It is the bidder’s responsibility to make sure that his bid is in the possession of the City Architect on or before 2:00 p.m., Tuesday, November 17, 2015.   Bids received after this time will not be considered.
