Hoover Man Sentenced to Seven Years in Prison for Ponzi Scheme that Bilked Millions from Investors

   BIRMINGHAM — A federal judge today sentenced a Hoover man to more than seven years in prison for defrauding investors out of more than $3 million through an illegal Ponzi scheme, announced U.S. Attorney Joyce White Vance, FBI Special Agent in Charge Roger C. Stanton, Alabama Securities Commission Director Joseph P. Borg and Hoover Police Chief Nick Derzis.

 
        U.S. District Judge Virginia Emerson Hopkins sentenced BRYAN W. ANDERSON, 41, to seven years and three months in prison for wire fraud, money laundering and securities fraud. Anderson pleaded guilty to the charges in March. In accordance with his plea agreement with the government, the judge also ordered Anderson to pay restitution of almost $3.1 million to the victim investors and to forfeit that same amount to the government as proceeds of illegal activity. Anderson must report to prison Oct. 19
 
        “Brian Anderson ran a Ponzi scheme for years, lying about investment options, risks and potential returns to lure unwitting investors into his snare,” Vance said. “Those investors trusted Anderson, and when his Ponzi scheme inevitably crashed down, they lost millions. I am proud of the collaboration among the FBI, Alabama Securities Commission, Hoover Police Department and the U.S. Attorney’s Office that, today, brings Anderson to punishment for his crimes,” she said.
 
        “Along with our partners, the FBI remains committed to investigating those who hide behind deceptive financial fraud schemes and victimize innocent consumers,” Stanton said. “I encourage members of the public to learn ways to protect themselves from fraud at  www.stopfraud.gov.”
 
        “While this sentence sends a strong message to Anderson and other con-artists thinking about victimizing Alabamians, nothing will ever make up for the damages caused to victims and their families who lost millions of dollars,” said the ASC’s Borg. “We appreciate the team effort of all agencies involved and were glad to provide resources to assist in an investigation that led to the prosecution of Anderson.” 
 
        “I’m very proud of the role our detectives played in the resolution of this complex investigation,” Derzis said. “Our Financial Crimes Unit is continuing to see bigger cases with significant financial losses to victims. In this particular case, we recognized the extent of the fraud committed by Mr. Anderson and contacted the Alabama Securities and Exchange Commission and the FBI,” he said. “We continue to have excellent relationships with our law enforcement partners and this case represents what can be accomplished when we work together.”
  According to court documents in the case, Anderson conducted his investment scheme as follows between 2009 and May 30, 2014:

               
        During most of that time, Anderson was a registered financial broker working, first, with MetLife Securities, from October 1998 to February 2012, then with Pruco Securities, from February 2012 to Sept. 13, 2012, when Pruco terminated his employment.
 
        As part of his scheme to defraud investors, he solicited them to invest in stock options that he said employed various trading strategies. The stock options he described were not registered securities, and Anderson had no authority to solicit investor money for the funds.
 
        Anderson also offered investments in a company he owned, 360 Properties. Beginning about 2009, Anderson falsely represented to certain 360 Properties investors that their returns would come from leased property income, when there were no leased properties. Some of the investors believed the 360 Properties investments were affiliated with MetLife, and Anderson did nothing to correct that false belief.
 
        Between January 2009 and January 2014, Anderson’s false investment promises caused about 18 individual and family investors to deliver more than $8.4 million to Anderson, which he deposited into an account he and his wife held at BancorpSouth, a bank based in Tupelo, Miss. When Anderson’s investment scheme collapsed in May 2014, about 12 investors lost about $3.1 million.
 
        Anderson was operating a Ponzi scheme with investor funds, paying returns to existing investors with money from new investors, as well as paying personal expenses. He transferred investor money from one of his and his wife’s bank accounts to another, making only a small percentage of the investments he had promised investors.
 
        Anderson pleaded guilty to wire fraud for causing an investor, identified in court documents by the initials K.C., to wire transfer $571,378 from the investor’s Wells Fargo bank account to Anderson’s BancorpSouth account in the name of 360 Properties on Jan. 15, 2014.
 
        Anderson pleaded guilty to money laundering for taking $368,000 of the $571,378 received from K.C. and, on Jan. 15, transferring it by wire to a second BancorpSouth account. The $571,378 was “criminally derived property” obtained through wire fraud. It is a violation of federal law to engage in a monetary transaction involving money or property worth more than $10,000 that was obtained through a criminal act.
 
        Anderson pleaded guilty to securities fraud for fraudulently obtaining $100,000 from an investor, identified by the initials T.M., on Aug. 20, 2013, by falsely representing that he would invest the money in a specific type of hedge fund. T.M. wired the money from an account at Bryant Bank to one of Anderson’s BankcorpSouth accounts and Anderson took the money and used it for non-investment purposes.
 
        The FBI, ASC and the Hoover Police Department investigated the case, which Assistant U.S. Attorney Pat Meadows prosecuted.

Boy Scouts Biking 3,900 Miles to Battle Cancer

Boy Scouts, biking 3,900-miles from Florence, OR to Wrightsville Beach, NC, will enter North Carolina on Saturday, August 15, with overnight stops scheduled in North Wilkesboro, Denton, Fayetteville, and Currie. The final destination is Wrightsville Beach, with bikers scheduled to arrive on Wednesday, August 19, at 11:00 a.m. (see daily itinerary below).

The mission of the seven Chapel Hill high school students is to honor a schoolmate lost to cancer and to raise awareness and funds for teen cancer programs.

CHAPEL HILL, NC – On June 15, seven Boy Scouts embarked on an epic bike journey from the Pacific seaside town of Florence, Oregon. Their destination, 66 days and 3,900 miles over the horizon, Wrightsville Beach, North Carolina. Their mission, to honor a schoolmate they lost to cancer and to raise awareness and funds for teen cancer programs.
The extreme cyclists, high school students in Chapel Hill, have now traveled almost 3,000 miles, successfully navigating the Cascades and Rockies, crossing the Continental Divide, descending into the Great Plains. Ahead, the Appalachian Mountains roll into North Carolina’s Piedmont and the coast, the entire trip without vehicle support.
The Trans-America odyssey, appropriately labeled Bike Loud! is slated to end on August 19 with a ceremony and a celebration at Blockade Runner Beach Resort in Wrightsville Beach. As the trip began in Oregon, it will close with a synchronized dip of bicycle wheels into the ocean. The public is invited to attend.
“I’m excited to bike across the country because it’s a once in a lifetime opportunity to challenge myself in a unique way,” said biker Max Morgan. “I’m also really glad that we will be raising awareness across the country for the Be Loud! Sophie Foundation.”
Sophie Steiner, diagnosed with germ-cell cancer in November 2012, died nine months later at age 15. Before her passing, Sophie expressed a strong desire to help other teens facing an overwhelming cancer diagnosis with non-clinical needs. Sophie’s wish led to the formation of the Be Loud! Sophie Foundation which supports teen cancer programs at UNC Hospitals.
The Boy Scouts have seen many acts of kindness and generosity on their journey including meals, overnight accommodations, refreshing swimming pools, and contributions to the Be Loud! Sophie Foundation. “This is the generosity we continuously encounter,” said biker Andrew de Figueiredo.

What’s Next: Birmingham City Council to Hold Post Budget Tour Outlining How They Plan to Make Sure That Budget Projects Are Completed

BIRMINGHAM, AL – The money has been put in place, and now it’s time for the work to begin. Birmingham City Councilors have been adamant since the budget process began about putting the funding and tools in place to revitalize our city neighborhoods and bring life back in to the communities. Councilors stood true on their promise to revitalize each district by passing a budget that includes $3.5 million dollars for weed abatement, $3 million dollars for property demolition, and a 3% cost of living [COLA] raise for all city employees. Now that money is in place, Councilors say the next step is to ensure that these projects are completed in a timely manner. The Council is planning to go back into each district and hold a post budget tour similar to the tour that they had prior to the budget to inform citizens on how they plan to make sure that each project is followed through.

“We are eager to see the progress that is to come, now that the budget has been passed and work can begin,” Council President Johnathan Austin said. “Our neighborhoods are the foundation for this city and for us to continue to thrive as a city we must continue to sew into these communities each and every day.

Alabama Attorney Releases Autobiography About Overcoming Poverty, Sexual Abuse on Way to Joining Auburn University Board of Trustees

BIRMINGHAM – A new autobiography released this month shares the inspirational story of an Alabama woman who overcame nightmarish events and tremendous adversity during her childhood to become a successful attorney, motivational speaker and member of the Auburn University Board of Trustees.
More Than A Bird (available at Amazon.com for $14.99; Kindle edition $8.99) recounts the childhood of Elizabeth “Liz” Huntley. Liz was born in the violent Butler Terrace housing project in Huntsville, Alabama, but raised in her grandmother’s home in Clanton, Alabama, following her mother’s suicide. From there, it details her emotional journey living in poverty and being sexually abused by her uncle, and profiles the men and women whom she believes God placed in her life to mentor her and help her meet her full potential. Birmingham Kitchen Table Relaunches With New Look and Feel

Birmingham, AL. (August 13, 2015) – The Birmingham Kitchen Table organization will celebrate its relaunch today through social media outlets and its interactive website. The rebrand takes place seven years after its original launch in 2008. By incorporating an all-new look and feel and implementing new goals and ideas, BKT plans to grow its diverse audience and revitalize the initial concept of bringing  positive change to the world through discussions about intriguing topics.

Since the beginning, BKT has fostered relationships in Birmingham through discussions sponsored by Samford University and o2ideas. During these events, participants are able to engage with others in small groups by sharing their thoughts on different subjects such as education, social media and human rights. To date, the events have been successful, bringing in more than 200 past participants, but BKT plans to expand its reach even more with the refreshed look and strengthened recruitment efforts.

“I’m grateful for a deep and abiding friendship with Shelley Stewart,” said Samford’s president, Dr. Andrew Westmoreland. “And through the Birmingham Kitchen Table, Shelley and I invite people from all walks of life to join us and make connections. The rebrand comes with a change in event location and updated look. The event will be held in Samford University’s all-new Brock School of Business. The refreshed look retains the original speech bubble concept, but with a modern execution to attract more millennial participants.

The next event will take place on Tuesday, August 25, and kicks off the rebrand with the new discussion topic related to society’s perception of beauty. Broken Bootstraps

“Making it big” in this country means being worth a lot of money.  It is not easy to get rich (in money) if you do not have wealthy parents or grandparents.  It is doubtful that someone who was born and grew up in poverty can become wealthy.  The assumption that a person “came from poverty, but worked hard and pulled themselves up by their bootstraps and made it big” is an unlikely reality in our current economic system.  The problem is our capitalistic culture regularly measures our importance and success by how much money we make rather than the moral and ethical values by which we live our lives.

A Pew Research Study found that a child in the lowest income range has only a 4% chance of changing that to the highest range when he or she becomes an adult.  There are more than 16 million children who live below the federal poverty level now and this number has grown by 23% since 2007.  Pulling ourselves up the by the bootstraps is a myth, because bootstraps in this country are not only weak, they are broken.

The National Center for Children in Poverty at Columbia University indicates that 22% of children in the United States are part of families whose incomes are less than $23,550 a year for a family of four.  Basic expenses like housing, nutritious food, transportation, and health care and child care cost twice that much annually.  Taking these basic needs into consideration, this translates into the fact that 45% of children live in low income families.  The most vulnerable are children under the age of 6 years old; 48% of children at this age are in low-income families.

Sadly, we often blame the situation on parents.  We accuse them of either not working hard enough or not managing their money well.  The truth is that many of these parents are working in jobs, often more than one that pay very low wages and are part-time or unstable.  It is very difficult to make ends meet under these circumstances and impossible to manage money you don’t have. Bootstraps are broken and the children we say we value are paying the price.

Research also proves that poverty is the single greatest threat to the well-being of children. To turn the tide on the tragedy of childhood poverty, we must demand that every child’s basic needs are met regardless of their family’s income.   Every child must have access to early childhood education programs and quality public schools, no matter where they are located.  They must have nourishing food and safe shelter to thrive rather than just survive.  We cannot just take care of our own little neighborhood or community.  We must invest in the future of ALL our children if we are to claim that we are a moral and just society.

This is a problem with our economic system and not the fault of our children.  In the current flurry of political positioning by presidential candidates, I want to hear them describe how they will address this national tragedy of childhood poverty that is growing by leaps and bounds each year.  I don’t want to hear about how hard work helps you get rich. It’s not about pulling up your bootstraps at all. It’s time for us to commit to the well-being of all families.

Drake’s ‘If You’re Reading This It’s Too Late’ Goes Platinum

The 6 God does it again.

Just six months after releasing If You’re Reading This It’s Too Late, it’s gone platinum. Drake’s surprise mixtape sold a whopping 624,000 copies in the first week.The charts report that it has officially sold 1,006,000.

In case you didn’t know, this is the fourth straight project that Drake has released that has gone platinum following Thank Me Later, Take Care, and Nothing Was the Same. Drake has been very clear that it’s not an album, rather a mixtape that was made available on iTunes.

The only track from the acclaimed mixtape to get a visual treatment is “Energy,” which has some Michael Jackson “Black or White” vibes to it as Drake’s face is super imposed on celebrities’ faces.

Drake defends the premise of the video stating, “Everywhere you go, there’s always someone who wants to pull you down and even celebrity friends of mine or people that I don’t know. I want people to rewind it a bunch of times and go and tell someone else to watch it. It’s shocking, it’s beautiful, it’s a lot of things”

The most recent news concerning the mixtape has been rather negative of course, as Meek Mill has accused Drake of having a ghostwriter. With standout songs like ‘Used To,’ ‘Know Yourself,’ and Meek and Drake’s collaboration ‘R.I.C.O.’ having reference tracks performed by Quentin Miller, the success has been a bit bittersweet.

But as Drake bodied Meek Mill in all aspects of the beef, it seems as if that chapter is behind him.

2nd Man Charged In Theft of $150K Left Behind By ATM Workers

MAHWAH, N.J. (AP) — A second man is in custody for allegedly making off with a bag containing $150,000 in cash that was mistakenly left behind by ATM workers in New Jersey.

Police say 35-year-old Jamar Bludson and another man took the money that had been forgotten outside a Mahwah business on July 27.

Officers found Bludson at a motel in Newark. He is being held on $125,000 bail, charged with theft of mislaid property.

Police believe Bludson was captured on surveillance video jumping out of a van and grabbing the bag. The driver of the van, 42-year-old Alton Harvey of Hillside, was arrested on July 31.

Authorities say Harvey told detectives he bought an SUV with some of the money.

Inside Ferguson Author Devin James Urges Leaders to Acknowledge Systemic Racism and Listen to the Voice of the Community
