Former Oklahoma City Police Officer Daniel Holtzclaw Found Guilty Of Rape

OKLAHOMA CITY (AP) — A former Oklahoma City police officer was convicted Thursday of 18 of the 36 counts he faced, including four counts of first-degree rape, related to accusations that he victimized 13 women on his police beat in a minority, low-income neighborhood.

Daniel Holtzclaw, 29, sobbed as the verdict was read aloud. He could spend the rest of his life in prison based on the jury’s recommendations, which include a 30-year sentence on each of the first-degree rape counts. Among the other charges he was convicted of were forcible oral sodomy, sexual battery and second-degree rape.

The jury, which deliberated for about 45 hours over four days, recommended he serve a total of 263 years in prison. The judge will decide later whether he will have to serve the sentences consecutively.

Holtzclaw’s mother, father and sister were in the courtroom as the verdict was read. At least one accuser was present, as well as several black community leaders. Seven armed deputies were stationed around the room.

The lead detective in the case, Kim Davis, said after the verdict: “I feel horrible for his family. It’s brutal, but I think justice was served.”

The allegations against Holtzclaw brought new attention to the problem of sexual misconduct committed by law enforcement officers, something police chiefs have studied for years.

During a monthlong trial, jurors heard from 13 women who said Holtzclaw sexually victimized them. Most of them said Holtzclaw stopped them while out on patrol, searched them for outstanding warrants or checked to see if they were carrying drug paraphernalia, then forced himself on them.

Prosecutors said in their closing arguments that many of the accusers have had troubled lives but that the law protects them as much as anyone else. Holtzclaw’s attorney described him as a model police officer whose attempts to help the drug addicts and prostitutes he came in contact with were distorted.

Holtzclaw did not take the stand.

The first woman to come forward was a grandmother in her 50s, who said Holtzclaw pulled her over during a traffic stop on suspicion of drunken driving. She said he ordered her into the backseat of his squad car, where he exposed himself and told her to perform oral sex.

Holtzclaw’s youngest accuser was 17 at the time of the attack. She accused him of escorting her to the front door of her mother’s house. There, she said, he pulled down her shorts and raped her.

Police said they used the GPS in Holtzclaw’s car and police databases to confirm he had been in contact with many of the women.

But despite the number of victims, the case presented prosecutors with several challenges.

Many of the women had arrest records or histories of drug abuse. Most hailed from the same neighborhoods in the shadow of the state Capitol. Two women took the stand wearing handcuffs and orange scrubs because they had recently been jailed on drug charges. Another woman admitted on the stand to slipping out of her motel room the night before and procuring marijuana and the hallucinogen PCP.

Holtzclaw’s attorney, Scott Adams, made those issues a cornerstone of his defense strategy. Adams questioned several women at length about whether they were high when they allegedly encountered Holtzclaw. He also pointed out that most did not come forward until police identified them as possible victims after launching their investigation.

Ultimately, that approach did not sway the jury to dismiss the women’s stories.

All of the women are black. Holtzclaw is half-white, half-Japanese. The jury appeared to all be white, though Oklahoma court officials said they did not have race information for jurors. Some supporters of the women questioned whether the jury would fairly judge their allegations.

A former college football star, Holtzclaw joined law enforcement after a brief attempt at pursuing an NFL career. Oklahoma City police chief Bill Citty fired Holtzclaw before the trial began.

Holtzclaw’s father — a police officer in his hometown of Enid, Oklahoma, about 100 miles northwest of Oklahoma City — and his sister regularly sat behind him in the courtroom, as did other family members and friends who maintained their belief in his innocence.

Also often in the courtroom were pastors and activists from the communities where the women live. Some wore teal to signify support for victims of domestic violence. Activists organized a protest outside the courtroom with loud chants calling for a life sentence, which could be heard inside during the trial.

Holtzclaw’s case was among those examined in an Associated Press investigation of sexual misconduct by law enforcement. The AP’s yearlong probe revealed about 1,000 officers had lost their licenses for sex crimes or other sexual misconduct over a six-year period. Holtzclaw was not included in that count because he has not yet lost his license.

The AP’s finding is undoubtedly an undercount of the problem of sexual abuse in law enforcement. Not every state has a process for banning problem officers from re-entering law enforcement, known as decertification. And of those states that do, great variations exist in whether officers are prosecuted or reported to their state licensing boards.

Wearing Short, Shorts in the Winter

I’m not one to wear shorts in the winter too often, but I have seen some people who can rock the look. It seems like this is becoming more of a trend and I love how people are putting their own twists on it.

Of course it’s better to wear tights or leg warmers; I don’t think it’s wise to go out in shorts only. I also think shorts looks better worn with some ankle boots or booties. Personally I don’t really like the shorts look with long or high boots unless they are thigh high boots. Thigh highs give the look more of an edgy look and are acceptable with shorts sometimes.

Shorts with tights give a more sophisticated look and a more runway look. I see many people who tuck in whatever shirt they’re wearing and wear a long coat or sweater with booties or ankle boots.

You can wear any type of shirt but it looks better tucked in, don’t wear any shirt that’s too long. I say this because most girls don’t wear long shorts, their shorts are usually at thigh and shorter than some may wear during the summer. I think the shorts being shorter bring the look together including accessories such as scarves or hats.

A great accessory I am seeing with shorts is one of the big floppy hats; those are perfect for an outfit with shorts. It’s cute. Other cute accessories are beanies, oversized jackets or coats, and a long necklace or a scarf as I said above. It all honestly depends on you and your style.

Now, just because wearing shorts in the winter is OK, please do not go out without anything on your legs. I can’t stress that enough because I see it at school. This goes for boys and girls. Girls are lucky because we have shorts, but guys you have no reason to wear shorts in the winter. I’m sorry, but please don’t and I’m saying this for your health.

If a guy wears shorts during the winter, and it’s a cold winter most of us think crazy thoughts about the guy. So to the men out there, I suggest sticking to jeans and sweat pants. Shorts are not your friend in the winter, unless you never get cold.

As a Licensed Stock Broker I spend a lot of time evaluating and picking stocks for the portfolios of my clients. I make decisions on a daily basis to buy or to sell. We classify stocks in several categories; growth, emerging, under-valued, etc. If Birmingham was a stock it would be an undervalued small cap stock.

An undervalued stock is defined as a stock that is selling at a price significantly below its assumed value. Stocks are also classified by size: large, mid, and small cap. Walmart is an example of a large cap company because of its enormous size, while Amazon is classified as a small cap stock since it is still relatively small and emerging based on its market capitalization.

There are several major cities in the southeast. Some of these cities include Memphis, Atlanta, Nashville, New Orleans, and Charlotte. When you look at these cities you will see that they have all experienced major population and economic booms over the last 30 years while Birmingham’s population has dropped. I contribute these population booms to their ability to become destination cities that draw tourists from all over the world.  Atlanta has become a mecca for entertainment,  African-American entrepreneurship, and business. Atlanta has also benefited from professional sports teams that bring millions to the city annually.  New Orleans has also benefited from successful professional sports teams and the strong history that is so uniquely captured through the Bourbon Street experience.  Nashville is the country music capital of the world. Charlotte has become the second largest banking center in the United States. Memphis has Beale Street and Elvis Presley’s history, along with its professional sports team, have taken the city to another level. Compared to these cities Birmingham is an undervalued stock that is poised to boom over the next five years.

When we evaluate a stock we usually begin with a fundamental analysis of the company, i.e. leadership, financial statements, management and competitive advantages. Let’s do a fundamental analysis of Birmingham. My analysis shows that the City of Birmingham has a strong CEO in Mayor William Bell. He has institutional knowledge with over 30 years of government experience. He is a big world thinker who understands branding and marketing. He is aggressively putting Birmingham on the national and international map as a city that is open for business. These moves are paramount in the future growth of this undervalued stock. The City of Birmingham has a competent, experienced, and forward thinking Board of Directors in its City Council. The strength of the Council is found in its diversity. They are not a rubber stamp body. You need this for growth. For the Board of Directors to succeed you need the wisdom of Steven Hoyt, the charisma of Jay Roberson, the deep thinking ability of Marcus Lundy, the grass root community compassion of Sheila Tyson, the strategic thinking of William Parker, the council experience of Valerie Abbott, the I’m going to make sure it passes the smell test of Lashaunda Scales, the analytical acumen of Kim Rafferty, and the strong leadership ability and always cool under pressure Johnathan Austin. For the most part Birmingham is financially sound and with the aggressive marketing of the City by both the Mayor and Council to the world, it’s just a matter of time before these business recruitment trips pay off.

We will eventually attract a mega event like the DNC.  We will eventually secure the funding and go ahead on the construction of the dome stadium, which will poise us for a professional sports team. We will eventually find the answers to some of our public transportation and education issues.

Some of the major challenges faced by the City of Birmingham is how do we become a destination city and improve its education system. Birmingham has to figure out how do we become a destination city and attract tourists from other cities. Yes, we have the Civil Rights Institute, McWane Science Center, Splash Adventure, Birmingham Zoo, and the Birmingham Museum of Art, but these alone will never be enough to make Birmingham a destination city. We have to uniquely and strategically position ourselves to answer this question. Until we become some sort of destination city beyond having these tourist attractions, we will stay a small cap undervalued city.

The City of Birmingham has all the tangible and intangible qualities needed to grow. We have strong and competent leadership; comparatively low cost of living; a financially sound government; a committed corporate community; and a succession pool of more than capable leaders after Mayor Bell that will continue to push for the growth of Birmingham.

For these reasons I am advising you to buy Birmingham now while the price is cheap. There are great things to come and you don’t want to be on the outside looking in!

BIRMINGHAM, AL – The Birmingham City Council took a bold step on Tuesday, December 8, 2015.  President Johnathan Austin restructured the Council’s committee assignments with the intent to build on past success while maximizing opportunities for policy improvements. In addition, President Austin also introduced a newly formed Governmental Affairs Committee to be chaired by Councilwoman Lashunda Scales.
“I am humbled to be chosen by President Austin to chair this committee,” said Councilor Scales. “Serving citizens through public policy is the committee’s primary goal.”
This committee, consisting of Councilor Scales, President Austin and Councilor Marcus Lundy, will be charged with developing legislative policies to enhance the city’s overall productivity while making a concerted effort to increase public participation through community outreach initiatives and technology. This committee also will fulfill the Council’s mandate to govern as the policy-setting and legislative branch of Birmingham city government.
As chair of the Governmental Affairs Committee, Councilor Scales has a clear vision and an ambitious agenda. Preliminary issues include policies for the city’s budget process as well as a legislative agenda to present to state lawmakers’ in the spirit of partnership and support.

40 Bowl Games, No Donald Trump!

It is very difficult for me not to write about Donald Trump.  I have not changed my mind regarding Donald Trump being a complete nut.  Nor have I changed my mind regarding him being President of the United States.

This week I am writing about the most important issues that take place in December and January.  The major issue is football.

We love bowls for one reason:  because they are college football games.  If there were fewer bowl games, there would be fewer football games before the eight-month off-season void.  We welcome bowls of all shapes, sizes, locales and levels of importance.

There are very watchable bowls and there are less-watchable bowls.  There are four things that make for watchable bowls: quality, evenness, excitement and happiness.  You could throw in familiarity and rivalry, but once the game starts, it has to be watchable.

The most watched game will be Oklahoma vs Clemson,, Michigan vs Alabama,, Notre Dame vs Ohio State, Michigan vs Florida and North Carolina vs Baylor.

The least watched games: San Jose State vs Georgia State, Arizona vs New Mexico, and Nevada vs Colorado State.

Now, the results of the top teams in Round One – Oklahoma will beat Clemson, Alabama will beat Michigan State.  At the present time, I have not decided who will win between Alabama & Oklahoma.  I am going to wait to make my prediction after Round One.

The greatest game of the season will be between Auburn and Memphis. The reason why this is the greatest game is because they are coming to the greatest city in the world – BIRMINGHAM, ALABAMA.  As always, we do several things when company is coming.

1.     Clean up and Dress UP.

2.     Be on your best behavior.

We want every individual that comes to the City of Birmingham on this great occasion to leave the City with an experience that they will remember for the rest of their life.

We want to make sure that no incidents happen. We will not break into anyone’s car.  We won’t steal the battery from anyone’s car.  We won’t rob anybody.  We will not cut or shoot anybody.

Every citizen in Birmingham should walk up to every stranger and say, “It’s nice to have you in our city.  What can we do to make your stay enjoyable?

I am hoping that there will be no vacant seats in the house for the game.

A new day ahead: Residents of all ages help plan the future of a new Southtown Court

Residents of all ages are participating in ongoing planning for Southtown Court and the greater Southside neighborhood. The Housing Authority of the Birmingham District (HABD) continues to host planning and community information meetings.

 

More than 30 children gathered for a recent session at the Southtown Recreation Center to offer their ideas for what is needed to enhance life in the neighborhood. The gym was transformed into a workshop filled with photographs, posters and giant sheets of blank paper where the young planners were guided in a workshop to design their new neighborhood.

 

The housing authority is seeking a $30 million federal Choice Neighborhood grant to transform the World War II era complex into a mixed-use, mixed-income community. HABD seeks to repeat successful revitalization efforts at Park Place downtown and Tuxedo Terrace in Ensley. Before any application is made or physical changes are begun, the housing authority is seeking the input from those most affected by the initiative. HABD will make its application in early 2016.

 

“Community participation at every level is essential as we envision a brighter future for Southtown,” said Interim HABD Executive Director Dontrelle Foster. “These series of meetings ensure that we as planners and administrators have the interest of our community at the forefront of everything we do and every step we take.”

 

With ideas focused heavily on modern housing, improved public facilities and access to nearby amenities, the young residents shared much of the same vision as previously expressed by the adults. A renewed Southtown is expected to deliver a strong positive impact throughout the surrounding community. HABD encourages Southtown residents, neighbors and all stakeholders to participate and take ownership in the community-wide conversation and planning sessions.

 

“It’s really important that they be involved in the process, and we get their input in making their lives better,” said Adam Rosa of Camiros, an HABD consultant facilitating the community conversations. “It’s not just a plan for Southtown Court. It’s a quality of life plan.”

 

Adults were encouraged to prioritize their needs in an exercise using “Southtown Neighborhood Bucks,” where they dropped money into buckets labeled with specific improvements. It wasn’t as easy as it sounded as residents spent several minutes lingering over each choice. In addition to a physical overhaul of the property, the HABD plan includes increased partnerships with nearby institutions for educational opportunities and career placement. The housing authority is preparing to release its draft plan for Southtown.

 

“It’s just as important as the physical part of the plan,” Rosa explained. “This plan has to stand on its own two feet, with or without the Choice money.”

 

Southtown intersects at one of Birmingham’s busiest corridors, which presents opportunities for both residents, nearby business and educational neighbors, officials said.

Delaware Jury Acquits White Officer of Assaulting Black Man [WATCH]

DOVER, Del. (AP) — A white police officer in Delaware seen on video kicking a black suspect in the head and breaking his jaw has been acquitted of assault.

A Kent County Superior Court jury deliberated for about 16 hours over three days before acquitting Dover police Cpl. Thomas Webster IV of felony assault Tuesday. The jury also declined to convict Webster on a lesser charge of misdemeanor assault.

Webster quickly left the courthouse through a side entrance, avoiding reporters.

Webster, 42, testified that he didn’t intend to kick Lateef Dickerson in the head in the August 2013 encounter and was instead aiming for his upper body. Webster also said he feared for the safety of himself and others because officers responding to reports of a large fight were told Dickerson was armed with a gun. He also testified that Dickerson was slow to comply with repeated commands to get on the ground.

Dashboard camera video from another officer’s vehicle shows that Dickerson had placed his hands on the ground but wasn’t fully prone when Webster kicked him.

Prosecutors argued that Dickerson was not a threat when Webster kicked him, and that the officer acted recklessly and used excessive force.

Webster rejected a pretrial offer from prosecutors to plead guilty to third-degree assault, a misdemeanor, in return for surrendering his certification and never working as a police officer again.

Dickerson, who has a lengthy criminal history and is awaiting trial on unrelated charges involving stolen guns, was charged with resisting arrest after fleeing from the officer at the fight scene. That charge was later dropped.

Fred Calhoun, president of the Delaware chapter of the Fraternal Order of Police, said the verdict shows the community has faith in its law enforcement officers.

“I think that it’s going to go a long way with my brothers and sisters that society has shown, at least in Dover, that they have had enough of being bullied and they have faith in the police and the job we do,” Calhoun said.

La Mar Gunn, president of the Central Delaware branch of the NAACP, called the verdict a setback for the black community: “I would just challenge the people to continue to have hope. … There are people who need justice to work, and this sends the wrong message.”

Meanwhile, prosecutors defended Democratic Attorney General Matt Denn’s decision to take the case to a second grand jury after he succeeded Beau Biden as attorney general.

“We feel vindicated by the fact that the jury took three days to deliberate,” said prosecutor Mark Denney Jr. “In light of everything, the new attorney general was entitled to have his shot at it … The second grand jury was a reasonable step.”

Denn declined to comment on the verdict.

Defense attorney James Liguori has said Webster’s indictment resulted from “state machinations” and an “abuse of power.”

Prosecutors first took the case to a grand jury last year but failed to get an indictment. The U.S. Attorney’s Office also concluded after a review that there was no civil rights violation. Liguori argued in court papers that Denn’s decision to take the case to a second grand jury with no new evidence was a politically motivated response to nationwide scrutiny of police encounters with black citizens.

Dover Police Chief Paul Bernat said in a statement that the department will evaluate the case and make a determination regarding Webster’s job status.

Webster has been suspended without pay since being indicted in May. In November 2013, he was placed on paid leave pending an internal investigation, which concluded that his actions were outside departmental policy. The police department has said it took “appropriate actions,” and Webster returned to duty in June 2014.

Meanwhile, Richard Morse, an attorney for Delaware chapter of the American Civil Liberties Union confirmed Tuesday that a federal civil rights lawsuit filed on Dickerson’s behalf has been resolved, but he declined to provide details.
