NAACP Statement on President Obama’s Clean Power Plan

0
WASHINGTON, DC – The NAACP has released the following statement applauding President Obama for his historic proposal to curb US carbon pollution as a key component of his comprehensive climate change plan. Power plants are the country’s single biggest source of carbon pollution – responsible for up to 40% of the country’s emissions of greenhouse gases. According to the plan, these measures will reduce the pollutants that contribute to life-threatening soot and smog by 70% which would have significant implications for communities of color. Three out of every four African Americans live within 30 miles of a coal-fired power plant. These communities are disproportionately represented among those with respiratory illnesses, such as lung cancer and pulmonary disease. In fact, African American children are 3 times more likely to be admitted to the hospital for an asthma attack and twice as likely to die of asthma.
From Cornell Williams Brooks, NAACP President and CEO:
“As we enter the third day of America’s Journey for Justice, I applaud President Obama’s introduction of the Clean Power Plan. Just as we march to preserve our right to vote and to ensure that our children have access to good schools and a quality education, we also march to preserve our rights to clean air, clean water and to communities less impacted by climate change. The NAACP will continue to advocate for safer, cleaner, healthier energy alternatives and the job opportunities that result from innovative energy solutions. We stand with President Obama’s efforts to establish the protections our communities need.”
From Jacqueline Patterson, Director, Environmental and Climate Justice:
“We stridently refute the contentions of those who have used an equity and civil rights frame to oppose regulations on carbon pollution by claiming undue cost burden on vulnerable communities. The cost these communities are paying from their close proximity to polluting plants and from choking down toxins daily is the toll that compromised health, negative educational outcomes and challenged work performance takes on community well being and growth potential. Still others see the devastating climate change impacts from pollution including disasters, rising sea levels, and decreasing availability of affordable nutritious foods, all of which disproportionately affect our most vulnerable communities. While further comment is forthcoming on the contents of this extensive plan as our focus is ensuring that it is a strong rule with a robust environmental justice analysis, we commend President Obama for finalizing carbon pollution standards and for advancing efforts to protect the environment on which we all depend for our very existence. We will work with the Administration and with the states to ensure that the state implementation plans prioritize energy efficiency and clean energy sources of solar, wind, and geothermal, while advancing community solar ownership models and job and entrepreneurship opportunities for low income communities and communities of color in the new energy economy.”

Founded in 1909, the NAACP is the nation’s oldest and largest nonpartisan civil rights organization. AG STRANGE ANNOUNCES RULING THAT UPHOLDS CONSTITUTIONALITY OF PAC-TO-PAC TRANSFER LAW

0
MONTGOMERY— Attorney General Luther Strange announced that a federal court has upheld the constitutionality of Alabama’s law banning PAC-to-PAC transfers. The state law bans transferring money from one political action committee to another.
The U.S. District Court for the Northern District of Alabama ruled in favor of the State on Friday, July 31, in the case of The Alabama Democratic Conference v. Strange.  The Court found that the State has a sufficiently important issue in preventing corruption or the appearance of corruption, that the ban supports this interest, and that the law was narrowly drawn so as to protect the State’s interest without being in violation of the First Amendment.
Attorney General Strange lauded the Court’s ruling. “I am pleased that the Court has upheld this important tool in Alabama’s ongoing fight against public corruption. We will continue to defend the PAC-to-PAC transfer law whenever necessary.” He commended his Constitutional Defense Division, noting in particular Assistant Attorney General Will Parker, and his Solicitor General’s Office for their outstanding work in this case.

Bobby Brown, Family Mourn Bobbi Kristina at Funeral; Leolah Brown Escorted Out [ Video ]

0

ALPHARETTA, Ga. (AP) — R&B singer Bobby Brown emerged from the funeral of his daughter Bobbi Kristina Brown, staring toward the ground before lifting his head up and briefly gazing at the sky.
Sporting a black dress shirt, the grieving Brown was one of the first to exit the tension-filled private service for Bobbi Kristina on Saturday at the St. James United Methodist Church in Alpharetta, just north of Atlanta. Twenty-two-year-old Bobbi Kristina was the only child between Brown and the late megastar singer Whitney Houston.
Bobbi Kristina died in hospice care July 26, about six months after she was found face-down and unresponsive in a bathtub at her town home.
Several celebrities showed up for the funeral including filmmaker Tyler Perry, Grammy-winning R&B singer Monica and Atlanta Mayor Kasim Reed.
In the middle of the service Bobby Brown’s sister Leolah Brown walked out of the church and spoke to reporters gathered outside. She said she was angry because Pat Houston was speaking at the funeral. Pat Houston is the sister-in-law and former manager for the late Whitney Houston.
“I told her that Whitney is going to haunt her from the grave,” Leolah Brown told reporters outside the church.
She suggested that the feud between the Houstons and the Browns was far from over.
“It’s just getting started,” she said before going back inside the church.
An email to the Houston family rep was not returned.
For years, there’s been a longstanding rift between the families of the young woman’s famous mother and father. Bobby Brown briefly appeared at Houston’s funeral three years ago, saying he and his children were seated but asked repeatedly to move. Brown said he left because he didn’t want to create a scene, but was upset.
Bobbi Kristina’s death was grimly similar to the way her mother had died three years earlier.
Houston’s assistant found the singer’s lifeless body face-down in a foot of water in her bathtub at the Beverly Hilton Hotel just before the Grammy Awards in 2012. Authorities found prescription drugs in the suite, and evidence of heart disease and cocaine in her body, but determined her death was an accidental drowning.
Bobbi Kristina was found in the town home she shared with Nick Gordon, an orphan three years older, whom Houston had raised as her own. Bobbi Kristina referred to him as her husband. A police report earlier this year described the incident as a drowning, and authorities are investigating her death.
Relations between Gordon and other relatives have soured over the past few years, especially after Bobbi Kristina was hospitalized. A protective order barred him from being within 200 feet of Pat Houston. And a feud erupted over whether Gordon could visit Bobbi Kristina while she stayed in the hospital.
Fulton County District Attorney Paul Howard said he and his office are interested in reviewing the investigative file to determine whether any charges will be filed.
Leolah Brown said she believes Gordon was involved in the death of her niece.
Lawyers for Gordon declined to comment.
Bobbi Kristina was raised in the shadow of her famous parents’ hugely public life.
She appeared alongside the couple in 2005 on the Bravo reality show “Being Bobby Brown,” which showed her parents fighting, swearing and making court appearances. She attended award shows with her mother and father, walked red carpets with them and sang in Central Park with Houston as adoring fans watched.
Houston and Brown were married 15 years. Their tumultuous relationship ended in 2007.
On Saturday, she was remembered in a private service. A hearse carrying Bobbi Kristina arrived nearly three hours ahead of the service. Four men dressed in black suits carried the coffin into the church.
Eight police motorcycles escorted three stretch limousines, carrying mourners to the church in Alpharetta ahead of the service. A procession of dozens of cars followed.
Security was heavy outside the church. About 75 members of the media stood behind a barricade at the entrance of the church parking lot, while more than two dozen onlookers were just a few feet behind them.
Alpharetta police say they were assisted by more than a dozen state troopers to manage traffic and shut down lanes to accommodate parking around the church where the service was being held.
Bobbi Kristina was the sole heir of her mother’s estate. She identified herself on Twitter as “Daughter of Queen WH,” ”Entertainer/Actress” with William Morris & Co., and “LAST of a dying breed.”
She told Oprah Winfrey shortly after her mother’s death in 2012 that she wanted to carry on Houston’s legacy by singing, acting and dancing. But her career never took off.
In her short life, Bobbi Kristina became a social media sensation, sending more than 11,000 tweets and attracting 164,000 followers.

Man Who Flew Into Birmingham Airport And Tried to Fly Out Under Assumed Names Wanted in Detroit for Murder

0
BIRMINGHAM — A man who flew into the Birmingham-Shuttlesworth International Airport under an assumed name in March 2014 is wanted in Michigan for the murder of his father-in-law, announced U.S. Attorney Joyce White Vance.
U.S. District Judge Karon O. Bowdre sentenced ROBERT ANTHONY RICKS, 31, of Detroit, to the 16 months he has served since his arrest in Birmingham, but ordered him to remain in custody so he can be transferred to Detroit.
Assistant U.S. Attorney Elizabeth Holt told Judge Bowdre that there is an arrest warrant and a court detainer for Ricks out of Wayne County, Mich., for his father-in-law’s murder. Holt said Ricks left Baltimore, Md., with his father-in-law on Feb. 21, 2014. The man’s body was discovered in Detroit in March 2014, but not identified until months later.
Ricks was arrested in Birmingham in March 2014 after flying into and attempting to fly out of the Birmingham airport under assumed names. He pleaded guilty in March this year to one count of illegally possessing a document identifying him as someone else and intending to use that document to enter an aircraft or secure airport area.
According to Ricks’ plea agreement, he flew from Atlanta to Birmingham on a Delta flight using another person’s ticket. That ticket was in the name of a person identified in court documents by the initials, U.W.
Once in Birmingham, Ricks obtained United Airlines boarding passes from Birmingham to Chicago, and from Chicago to Colorado Springs by telling a United representative in Birmingham that he was M.M. Ricks made the claim at a United boarding gate after hearing a public address system message for M.M.
Ricks was arrested after he left the secure area of the Birmingham airport, twice tried to re-enter the area by going up the down escalator, and then tried to go through Transportation Security Agency checkpoints using one of the United boarding passes.
Holt told Judge Bowdre that it is still unknown how Ricks got to the Atlanta airport.
The FBI investigated the case, which Assistant U.S. Attorney Elizabeth Holt is prosecuting.

Troy University’s Johnson Center: A Poor Steward of the Truth

0

By Dr. David G. Bronner

A lie gets halfway around the world before the truth has a chance to get its pants on.” -Winston Churchill

On July 29, AL.com published a guest opinion editorial written by Daniel J. Smith, an associate professor of economics at the Johnson Center at Troy University criticizing the Retirement Systems of Alabama as a “poor steward” of retirement resources. The article is scandalously inaccurate and comes from an institution which is partially funded by an organization that seeks to abolish public pensions. The Johnson Center has a history of publishing debunked “studies” that are widely known to contain false claims, such as asserting that RSA is running out of money.

The Johnson Center and Professor Smith’s continued reckless perpetuation of these falsehoods only serves to confuse people and make hundreds of thousands of RSA members and their families feel uncertain about their financial security. That is wrong and we have a duty at RSA to make sure that the public and our members know the truth. Here are a few examples of the most egregious of these misrepresentations and the facts that disprove them:

Johnson Center: RSA is not solvent and retirees’ benefits will be reduced.

Truth: Between 2009 and now, RSA has paid out about $15 billion in benefits to its members and increased its assets by 46% to approximately $35 billion. Thus, today RSA has $11 billion more in assets after meeting all of its obligations than it did in 2009. RSA is NOT running out of money and there is NO CHANCE that retirees’ benefits will be reduced.

Johnson Center: RSA makes risky investments and falsely “self-report[s]” that it is financially sound.

Truth: Consistent with best practices, RSA invests its members’ assets in a diversified portfolio that is allocated among stocks, bonds, real estate and private placements. RSA’s overall investment returns have averaged almost 11 percent for each of the last five years and are calculated by an independent third party custodian – not RSA. RSA’s investment returns have been ranked in the top 13% of all major public pensions for the last three years and in the top 25% over the last five years.

Johnson Center: RSA plays “fast and loose” with members’ money when it invests in private companies.

Truth: About 80% of RSA’s investments are in publicly traded stocks and bonds. Private placements, which include investments in privately held businesses, comprise only about 10% of

RSA’s overall portfolio. In the fiscal year ending September 30, 2014, private placements earned approximately 13.5%. There is no investor who always picks profitable investments, but RSA has a proven record of picking more winners than losers. By the way, Warren Buffett thinks this is a good investment strategy: he’s purchased 100% ownership stakes in over 50 companies.

Johnson Center: RSA uses “questionable accounting practices.”

Truth: RSA’s holdings are audited annually by an independent Certified Public Accounting firm to ensure that RSA’s accounting practices comply with all applicable accounting standards, including those of the Governmental Accounting Standards Board (GASB). RSA is also audited periodically by the Alabama Department of Examiners of Public Accounts. RSA has never been found to have engaged in any dubious accounting practice.

Johnson Center: RSA is underfunded because of its bad practices.

Truth: RSA has an unfunded liability, but no more than the average public pension fund and not at a level which poses a threat to the sustainability of the system. The causes of RSA’s underfunding are the financial collapse of 2008 and numerous expensive unfunded cost-of-living increases passed by the Legislature. RSA’s situation is like a homeowner who doesn’t have all the cash in the bank to pay off his mortgage, but instead pays it off over time. RSA has implemented a plan, which is already working, to pay off its unfunded liability.

The RSA takes its fiduciary responsibility of paying lifetime benefits for its members and the many generations of future members very seriously. The RSA has modified its policies and worked with the Legislature to make changes that have made the retirement system more sustainable. The RSA’s investments in Alabama and the benefits it pays to its members help support Alabama’s economy and its citizens while earning average annual returns of 8% over the last 25 years. Rather than perpetuate misinformation about RSA, the Johnson Center and Professor Smith should concentrate on creative writing, since they are so talented at creating fiction.
