Albert Joyner, one of the nation’s most successful owners of McDonald’s franchises and philanthropist, passed away in Jackson, Mississippi on Wednesday June 3, 2015. He was 69.

Joyner was a fervent family man and is survived by his wife, Danita, and four children – Michael, Allison, Danielle and Albert Jr.  He is also survived by his brother, Tom, and nephews Thomas Joyner, Jr. and Oscar Joyner.

Albert shared his brother, syndicated radio personality Tom Joyner’s, passion for education and served as an active board member of the Tom Joyner Foundation.

Known for his dry wit and keen business acumen, he bought his first McDonald’s franchise in Mobile, Alabama.  With the success of this first restaurant, he formed My Joy, Inc. and went on to own numerous franchises in Birmingham and Jackson, Mississippi.  Mack Wilbourn, one of the first minority McDonald’s franchises in the Southeast, as well as Joyner’s mentor and friend, has said that one of his greatest accomplishments was mentoring Albert Joyner.

Always with an eye to make something happen – Albert collaborated with his brother to break the regional record for the most cars served in a McDonald’s drive-through in an hour at one of his Jackson Mississippi locations.  At the end of the hour, 419 cars had been served, breaking the previous record of 288 at a Baton Rouge McDonald’s.

Born in Tuskegee, Alabama, Albert Joyner attended Tuskegee Institute High School and graduated from the famed Tuskegee University (née Institute), majoring in physical education.

Police: Georgia Woman Locked Son Out For Missing Curfew

AUGUSTA, Ga. (AP) — A Georgia woman is accused of locking her 13-year-old son out of the house overnight as punishment for missing his curfew, leaving him to sleep on the concrete patio in the backyard.

Antonia Folsom was arrested May 26 on a charge of deprivation of a minor, according to an incident report from the Richmond County Sheriff’s Office.

Folsom didn’t immediately return a phone message left Wednesday at the number listed for her in the report.

Folsom’s son told a sheriff’s deputy that he had returned home after his 9 p.m. curfew the night before and found the doors locked. His mother came to the door and told him she was tired of him coming home late and that he should find somewhere else to go, the teen told the deputy.

The teen’s 15-year-old brother gave him a pillow and blanket without their mother’s permission. The teen said he continued to knock on the door but got no response and had to sleep on the backyard patio.

Folsom left for work the next morning and told her older son not to let his brother inside, the report says.

The deputy spoke to Folsom that day when she returned home at about 3:15 p.m. She told the deputy that her son didn’t return home by curfew and that she didn’t know where he was. She said she hadn’t spoken to her son but did see him walking around in the yard the night before.

In a written statement, she said she saw her son kick a trash can around 11 p.m. the night before and told him to come inside but that he ignored her and left.

Folsom was arrested and booked into the county jail. She was released at 6:30 a.m. May 28 after posting $1,300 bond.

Folsom’s children were turned over to their grandmother.

Serra Nissan Controller Arrested on 16-Count Indictment

0
BIRMINGHAM – Federal agents this morning arrested KIMBERLY H. BRANCH, controller for Serra Nissan, based on a 16-count indictment returned by a federal grand jury last week, announced U.S. Attorney Joyce White Vance, Federal Bureau of Investigation Special Agent in Charge Roger C. Stanton and Internal Revenue Service-Criminal Investigation Special Agent in Charge Veronica Hyman-Pillot.

The indictment against Branch, 34, of Trussville, was unsealed this morning following Branch’s arrest at the car dealership. The indictment includes charges of a conspiracy and wire fraud related to a scheme to defraud Nissan North America Inc. between March 2013 and April 2013. According to the charges, Branch and others at Serra Nissan falsely reported cars as having been sold at Serra Nissan in Birmingham in order to obtain additional incentive payments that the dealership did not earn. This process, called “pooling sales,” occurs when a dealer owns or is associated with more than one dealership and combines or attributes sales from one dealership to another in order to meet sales incentives levels that each dealership would not reach on its own.

According to the indictment, Branch is the controller at Serra Nissan and was responsible for instructing another Serra Nissan employee to create false documents to hide the fraud, in the event Nissan North America audited the dealership. The 15 vehicle sales fraudulently reported at Serra Nissan caused Nissan North America to pay the dealership $82,750 in incentives, according to the indictment.

FBI and IRS-CID investigated the case, which Assistant U.S. Attorneys Amanda S. Wick and Jennifer S. Murnahan are prosecuting.

The public is reminded that an indictment contains only charges. A defendant is presumed innocent unless and until proven guilty in court.

United States Contracting Official Charged with Obstructing a Federal Audit

BIRMINGHAM – Federal prosecutors today charged a civilian contract officer working with the U.S. Army Contracting Command at Redstone Arsenal with obstructing an audit by the Department of Defense, Office of Inspector General (DODIG), announced U.S. Attorney Joyce White Vance and Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division.

The U.S. Attorney’s Office filed a one-count information in U.S. District Court charging TERESA MAYBERRY, 54, of Huntsville, with obstruction of a federal audit. Mayberry created a series of false documents that she provided to DODIG to obstruct its 2012 audit of an Army contract to purchase parts for Russianmade Mi-17 helicopters, according to the charge. Mayberry has entered a plea agreement with the government, also filed today in District Court, in which she acknowledges the charge against her and states her intention to plead guilty.

The Special Inspector General for Afghanistan Reconstruction (SIGAR), the Defense Department’s Defense Criminal Investigative Service (DCIS), U.S. Army Criminal Investigation Command (CID), the FBI and the Internal Revenue Service Criminal Investigation Division (IRS-CI) are working jointly in the investigation of fraud and corruption in Mi-17 helicopter contracting.

“Fraud and corruption in military contracting is theft from all of us who pay taxes,” Vance said. “It harms our mission overseas and undermines the confidence of the American public, which demands a military procurement system that spends tax dollars wisely and responsibly,” she said. “Particularly in light of the move of Army Materiel Command onto Redstone Arsenal, this investigation should serve as a warning for those who seek to defraud the U.S. military and the American public that my office will pursue these crimes aggressively.”

According to the information filed today, in late 2011 and 2012, DODIG was investigating contracts involving overhauls and purchases of spare parts, amounting to more than $8 million, for Russian-made Mi-17 helicopters. It was material to DODIG to determine whether the Army paid a reasonable price for the parts, whether the parts purchased were needed, and whether proper contracting procedures were followed.

Mayberry was involved in implementing the parts contract, which she had signed on behalf of the United States. In the course of the investigation, DODIG several times requested contracting documents from Mayberry related to the decisions to purchase spare parts. On several occasions, Mayberry prepared, and directed her subordinates to prepare, a variety of false and backdated documents that she provided to DODIG in response to its requests, according to the information. As an example, the information charges that Mayberry caused the creation of a backdated document, bearing her signature, which falsely represented that price negotiations had taken place on parts purchases.

The charge carries a maximum penalty of five years imprisonment and a $250,000 fine.

The SIGAR, DCIS, Army CID, FBI and IRS-CI are investigating the case. DOJ Trial Attorney Mark H. Dubester of the Criminal Division’s Fraud Section (on detail from SIGAR), and Assistant U.S. Attorneys Henry Cornelius and Ramona Albin are prosecuting the case.

UNCF Birmingham hosted its annual Masked Ball at the Sheraton Hotel Ballroom Saturday, March 14th. As the nation’s oldest and most successful minority education assistance organization, UNCF’s mission is increasing minority degree attainment by providing financial support to 37 member institutions.
The Masked Ball is one of the Magic City’s premier social occasions and leading black-tie fundraisers of the year. The event features included a reception, silent auction, and elegant dining. Without events such as this one, UNCF would not be able to provide the support to over 60,000 students. Carl Crosby, Executive Vice President of Human Resources of BBVA was this year’s Chair and Mayor William A. Bell, Sr. was the Honorary Chair.
Sherry Lewis, First Vice President of the Birmingham Water Works Board, received the MASKED Award. Ms. Lewis brings experience and energy to not only the Water Works but to everything she touches. Sherry Lewis has over two decades of working in the community and has spearheaded a high school internship program and the “Wonderful Works of Water” school program for fifth graders that explains the fundamentals of water as it relates to science. Ms. Lewis is a summa cum laude graduate of Miles College.
UNCF 2015 event raised $300,000. The event featured a call for audience members to donate to UNCF by Mayor Bell. “These proceeds will allow UNCF to extend thousands of dollars in support of students from Alabama, helping them to pursue a college education,” said Mayor Bell.
There were over 700 businesses and civic city leaders who came together to raise funds for low income African-American students.
The night ended with special guest R&B singer, Johnny Gill singing hits like “My, My, My” and “Rub You the Right Way”. Johnny Gill is a member of New Edition and is currently in the new group Heads of State and touring with Bobby Brown and Ralph Tresvant.

Teen Driving

To see Children’s of Alabama experts discuss this topic, click here.

When a teen starts to drive, it’s a thrilling time for him or her, but often a terrifying time for mom and dad — and with good reason.  Nearly half a million teens are injured in crashes on American roadways every year and 3,800 die.

Many factors contribute to teen driver crashes. They include driving while using alcohol or drugs and not wearing seat belts.

Kathy Monroe is the medical director of the emergency department at Children’s of Alabama.  Unfortunately she sees first-hand the consequences of teens practicing unsafe behaviors behind the wheel of a car.

“Teen crashes are often caused by poor decisions like not wearing a seatbelt, speeding, or drinking and driving,” she said. “Often crashes happen due to nothing more than inexperience- they run off the edge of the road, they over correct, that leads them to crash into another car.  Inexperience often leads to crashes.”

Often distractions contribute to a crash. These may take the driver’s eyes, ears and attention away from the road. The most common distractions include:

  • Too many passengers in the car
  • Talking on cell phones while driving
  • Texting while driving
  • Eating or drinking while driving
  • Adjusting the radio, CD player, temperature controls, etc.
  • Loud music in the car or wearing headphones

The good news is, studies show that parents can play an important role in encouraging the safety of their teen behind the wheel.

“There’s very good evidence that 1,000 miles of supervised driving with an experienced driver dramatically decreases crash rates for teen drivers,” said Monroe.

She said often parents encourage their teens to practice driving when conditions are favorable, but that’s not preparing them for real life situations. Instead, it’s important that a teen practices driving as frequently as possible in all conditions and multiple scenarios: interstate, backroads, nighttime and rain.

Not only that, remember that whenever you’re behind the wheel, your “driver in training” is watching. “No parent thinks any teen is listening to them,” Monroe said. “And they may or may not be listening but they’re watching, so know your behavior affects their behavior.”

In fact, research shows that teens involved automobile accidents are more likely to have parents who are poor drivers.

Graduated Driver License

One approach that’s been very successful in reducing teen driving accidents is the Alabama Graduated Driver License Law.

The Graduated Driver License contains three components:

  • Curfew
  • Limit of passengers
  • No handheld devices

The Alabama Graduated Driver License Law places restrictions on young drivers to help ensure their safety. Parents should know this law and enforce it with their teen drivers. Your pediatrician can provide a copy of the law to you today or you can visit www.childrensal.org.

Driving is a complex skill that requires education and lots of practice. Parents play a crucial role in teaching their teens to drive safely.

Nationwide — “Our problem is we sound too good to be true,” says Maria Solomon, Head of EOS Studios in Cleveland, Ohio. EOS Studios is a woman-owned African American firm that produces large and small scale 3D Animation. EOS specializes in the emerging field of 3D Projection Mapping.

3D Projection Mapping, also known as video mapping, urban projection, architectural mapping and spatial augmented reality, is a projection-based technology that merges animation, motion graphics and special effects. 3D Projection Mapping is being used by movie makers, entertainers, artists, architects, designers and event planners as well as advertisers and marketers of all types to provide memorable messages through jaw-dropping 3D effects.

Maria explains, “Weve perfected a process where we can create 100% custom 3D Projection Mapping for any purpose you can imagine and do it at a level which would ordinarily take at least a half dozen Animators or more, which keeps our costs very competitive in the industry.” A full scale 3D Projection Mapping project can run deep into six figure territory.

Michael Solomon, Marias husband, is Lead Animator and Creative Director. He comments, “Our digital lighting partner is a well-established, industry leading firm – you want 3D projections mapped across the Statue of Liberty or the Washington Monument? Done. You want 3D projections mapped across a Football Stadium, Baseball Diamond, Basketball Court or Concert Venue? Done. You want 3D projections coming out of your kids toy box at home? Done.”

He continues, “In my opinion, not only is 3D Projection Mapping the future of marketing and advertising, 3D Projection Mapping is the future of entertainment as a whole. Its like mans discovery of fire all over again. Worldwide, weve only scratched the surface of what 3D Projection Mapping can do as an art and a science.”

Jay Z and the Establishment Negro

Jay Z and the Establishment Negro

By: James Strong

The plane of success will at some point nosedive into a storm of controversy—not because it wants to, but because it has to. Jay Z, the rap star who became a multimillionaire through his music and by becoming a music producer, owner of a sports agency and investor in various profitable businesses, found this fact recently to be more real than he expected. The rap mogul excited both fans and Wall Street when he launched Tidal, a music streaming website offering music from such famous musicians as Prince, Alicia Keyes, Kanye West, Daft Punk, Madonna and Nicki Minaj. He said he formed the company because other streaming services did not pay artists enough for streaming their music and he wanted to correct that. That reason sang a tune worthy of a million hand claps, until you faced the sticker shock. Z charges subscribers to Tidal between $9.99 and $19.99 per month to listen to music from 20 to 40 musicians. In contrast, Pandora, YouTube, Spotify and other much larger music streaming sites with hundreds of artists offer their services free.

As you can see, a substantial gap separates him from them. He offers less for more; they offer more for less.Critics from Wall Street to house cleaners, from millionaires to poodles blasted Jay Z for trying to make millionaire musicians richer by stealing from poorer fans and admirers. Even major musicians such as Mumford & Sons, Lily Allen and singer Ben Gibbard from Death Cab for Cutie criticized him for his richer than thou music streaming service. Gibbard predicted that Tidal “[will] fail miserably.”

Then, to compound the issue, after scolding the black community for not supporting black businesses, his wife, pop sensation Beyonce, uploaded a photo of Jay Z with Tidal’s all-white staff. He never told the world that he didn’t actually create a new company. Instead, he bought the Swedish/Norwegian firm Aspiro, and the white people came with it.But the damage had already been done, as the ceaseless ridicule he received on social media battered his ego with the force of a jackhammer. So much so that at his TIDAL X: Jay-Z B Sides concert at Terminal 5 in New York City on May 17, he criticized his critics in a rap song with such stupid lyrics as:

“I feel like YouTube is the/ biggest culprit/Them niggas pay you a tenth/of what you supposed to get/You know niggas die for equal/pay right?”

Jay Z needs to stop shuckin’ and jivin’. His plane descended into a storm and crashed. He is now a member of the establishment. But that’s not always bad.He should imitate the best qualities of those establishment blacks who love their people and carry a genuine concern for the future of the black community. He should follow the example of Bill Cosby—minus the rape, of course–and not exploit black America as if she were dandruff to be marketed as grains of gold.

Even during those years when he raped mostly white women, Cosby gave millions to black colleges, participated in civil rights marches and encouraged black kids to live a decent, honorable, hard-working life as eminently as an emerald. Thus, Jay Z should avoid those qualities the establishment negro, the opposite of the establishment black, is often praised for: Selfishness, deception, untrustworthiness, snitching, hypocrisy, greed and materialism.

Establishment negroes feign devotion to black America. They place so much emphasis on personal status and ambition, on maintaining a lifestyle which may be lavishand acceptable to whites, that they will deride and demean blacks to maintain that status. To save their reputations in the white community and to ensure they are not excluded from playing golf at the nearby country club or hitting tennis balls on a private tennis court, for them, the black community is almost a forgotten dream, as artificial to their way of life as corn syrup. In this sense, establishment negroes are cold as ice, irrelevant to the future of black America, unashamed of that which brings shame. In this sense, Jay Z has the superbopportunity to surpass Cosby in character and achievement, to align himself with the bestthe black establishment has to offer and to not languish as burnt toast overspread with mayonnaise.
